PUBLIC USER AGREEMENT (OFFER)

for ordering, purchasing, selling, and delivering goods

By publishing this Public Sales Agreement (Offer) below, as well as the information available on the Koreiko Corset House website (the “online store”, hereinafter referred to as the “Store”), the Seller — Sole Proprietor (FOP) Koreiko Yuliia Viktorivna, EDRPOU code 3555603364, registered at: 6 Lesi Ukrainky St., Apt. 45, Sviatopetrivske village, makes a public offer to an unlimited number of individuals and legal entities to purchase goods displayed on the Website/Store under the terms of this Public Sales Agreement.

Use of the Website/Store services by the user (customer), hereinafter referred to as the Buyer, confirms the Buyer’s full acceptance of this Agreement and consent to the terms set out below.

1. DEFINITIONS

1.1. Public Offer (the “Offer”) — a public proposal of the Seller addressed to an indefinite number of persons to conclude a distance sales agreement with the Seller (the “Agreement”) under the terms of this Offer.

1.2. Order — the Buyer’s decision to order goods and delivery, placed in the online store and/or an instruction to purchase and deliver goods.

2. GENERAL PROVISIONS

2.1. The information below constitutes an official offer of the Koreiko Corset House online store to any individual (the Buyer) to conclude a sales agreement. This agreement is public; therefore, pursuant to Article 633 of the Civil Code of Ukraine, its terms are the same for all Buyers.

2.2. Pursuant to Article 642 of the Civil Code of Ukraine, full and unconditional acceptance of this Offer, which confirms the conclusion of the Agreement on the terms set out below, is the fact of placing and confirming an Order.

2.3. By placing an Order, the Buyer confirms agreement with and unconditional acceptance of the terms of this Offer.

2.4. By concluding the Agreement (i.e., accepting the terms of this Offer by placing an Order), the Buyer confirms that:

  • the Buyer has fully read and agrees to the terms of this Offer;

  • the Buyer consents to the collection, processing, and transfer of personal data under the terms set out below in the Personal Data notice. Such consent remains valid throughout the term of the Agreement and for an unlimited period after its termination.

  • the Buyer is informed (without additional notice) about the rights provided by the Law of Ukraine “On Personal Data Protection”, the purposes of data collection, and that personal data is transferred to the Seller to enable performance of this Agreement, settlements, and issuance of invoices, acts, and other documents.

  • the Buyer also agrees that the Seller may provide access to and transfer the Buyer’s personal data to third parties without additional notifications, without changing the purpose of processing.

  • the scope of the Buyer’s rights as a personal data subject under Ukrainian law is known and understood by the Buyer.

3. PRICE AND AVAILABILITY OF GOODS

3.1. The price of each item is indicated on the Koreiko Corset House website.

3.2. The Seller has the right to change the price of any item unilaterally.

3.3. If the price of the ordered goods changes, the Seller shall inform the Buyer about the price change.

3.4. The Buyer has the right to confirm or cancel the Order if the price was changed after the Order was placed.

3.5. The delivery cost is indicated on the website or communicated by a manager during order placement.

3.6. The Buyer’s payment obligation is deemed fulfilled from the moment the Seller receives the funds.

3.7. Payments are made using the methods specified on the website in the “Delivery & Payment” section.

3.8. The “in stock” status does not guarantee actual availability. Availability is confirmed by the manager.

4. ORDER PLACEMENT

4.1. The Buyer may place an Order through a manager by phone (numbers indicated on the website) or via the website service of the Koreiko Corset House online store.

4.2. When registering / placing an order, the Buyer must provide the following information:

  • 4.2.1. First and last name of the Buyer or the specified recipient;

  • 4.2.2. Delivery address (if delivery to the Buyer’s address is requested);

  • 4.2.3. Contact phone number.

4.3. The name, quantity, SKU (if applicable), and price of the selected goods are displayed in the Buyer’s cart on the website.

4.4. If additional information is required, the Seller may request it from the Buyer. If the Buyer fails to provide necessary information, the Seller is not responsible for inability to provide high-quality service.

4.5. When placing an Order through a manager, the Buyer must provide the information specified in clause 4.2.

4.6. Acceptance of this Offer is carried out by entering the relevant data into the form on the website or by placing an Order through a manager. After an Order is placed through a manager, the Buyer’s data is recorded in the Seller’s database.

4.7. The Buyer is responsible for the accuracy of the information provided.

4.8. The distance sales agreement is considered concluded from the moment the Order is placed electronically via the website service or when the Seller issues to the Buyer a cash receipt / товарний чек or another document confirming payment.

5. DELIVERY AND HANDOVER TO THE BUYER

5.1. The delivery methods, procedure, and delivery timeframes are communicated by the manager. The Buyer agrees delivery terms with the manager at the time of purchase.

5.2. Delivery:

  • 5.2.1. After the Order is formed, the Buyer may pay for and receive the goods at the address indicated on the website (if applicable).

  • 5.2.2. Title to the goods and the risk of accidental loss or damage passes to the Buyer (or the Buyer’s representative) from the moment of receipt of the goods and signing of the receipt/order and/or delivery instruction.

5.3. Delivery may be performed with the involvement of third parties (delivery services).

5.4. Upon receiving the goods, the Buyer must, in the presence of the courier, check that the goods match the order in terms of quantity and quality (name, quantity, completeness).

5.5. By receiving the goods, the Buyer (or representative) confirms there are no claims regarding quantity, appearance, or completeness.

6. RETURNS

6.1. The Buyer has the right to refuse the goods at any time before handover, and after handover — in the manner and on the terms established by the Law of Ukraine “On Consumer Rights Protection”.

6.2. Return of new goods of proper quality is possible only if their commercial appearance and consumer properties are preserved, as well as a document confirming purchase and the terms of the order.

6.3. The Buyer may not refuse goods of proper quality that have individually determined properties if such goods can be used exclusively by the consumer who purchased them (including non-standard sizes made at the Buyer’s request, etc.). Confirmation that the goods have individually determined properties is the difference in sizes and/or other characteristics from those indicated for standard goods in the online store.

6.4. Returns in cases provided by law and this Agreement are made to the address indicated on the website in the “Exchanges & Returns” section.

6.5. In case of return of goods of proper quality, the Seller refunds the cost of the goods, excluding the Seller’s delivery expenses.

6.6. The refund specified in clause 6.5 is made within 10 business days after the Store receives the returned goods.

7. LIABILITY OF THE PARTIES

7.1. Product descriptions, technical characteristics, and photos on the Website are for informational purposes only. Exact information is provided by the manager.

7.2. The Seller is not liable for any damage caused to the Buyer as a result of use of goods ordered on the Website and purchased from the Seller.

7.3. The Seller is not liable for improper or delayed performance of orders in case the Buyer provides inaccurate or erroneous information.

7.4. The Seller and the Buyer are liable for fulfillment of their obligations in accordance with the applicable laws of Ukraine and this Agreement.

7.5. Force majeure. The Seller or the Buyer is released from liability for full or partial non-performance if such non-performance is caused by force majeure circumstances such as war or military actions, earthquake, flood, fire, or other natural disasters that occur independently of the will of the parties after the conclusion of this Agreement. The party unable to perform its obligations must immediately notify the other party.

Personal Data (Consent for Credit/Installment Processing)

In order to comply with the Law of Ukraine “On Personal Data Protection”, by filling out an application on the Website to consider the possibility of purchasing goods on credit and clicking the button “I confirm the order”, I give my consent to the processing of my personal data indicated in the application by financial institutions that provide credit/financing options on the Koreiko Corset House website, for the purpose of enabling civil-law relations, providing/receiving and performing settlements for purchased goods/services, including through financing.

I do not object to such financial institutions verifying information in any credit bureaus of Ukraine to establish information relating to my fulfillment of obligations under agreements (including credit agreements), if any. I understand that the scope of information checked may include information constituting bank secrecy and may be sufficient to assess my social and financial status, solvency, and potential property liability, if necessary.

I also agree that the Data Controller has the right to provide access to and transfer my personal data to third parties without additional notice, without changing the purpose of processing as defined in the Policy and this Agreement, including for verification of the information provided and for transfer to third parties if required for clarification.

I provide consent to request and receive from credit bureaus included in the Unified Register of Credit Bureaus (the “Bureaus”) data in the form of aggregated indicators formed on the basis of information contained in my credit history and/or information available from open sources, using the Bureaus’ calculation models, and to use such information by the Data Controller and/or third parties to determine and offer marketing/special offers (financial limits) on the Koreiko Corset House website for purchasing goods and/or services.
